Terms of Service

These Terms of Service ("Terms") govern your access to and use of the InMedia Developer AI platform, websites, APIs, and related services (collectively, the "Service") operated by InMedia Developer AI ("we", "us", or "our"). By creating an account or using the Service you agree to be bound by these Terms.

1. Eligibility & Accounts

You must be at least 16 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

2. The Service

InMedia Developer AI provides an AI-assisted environment for building web, mobile, desktop, and API applications, including code generation, sandboxed execution, project storage, and related developer tooling. Features may change, be added, or be removed as the Service evolves.

3. Subscriptions, Credits & Payments

3.1 Plans

The Service offers a Free plan and paid subscription plans (currently Pro Monthly and Pro Yearly). Paid features become available upon successful payment.

3.2 AI Credits

AI usage is metered in credits. Included monthly credits are granted at the start of each billing period and expire at the end of that period; they do not roll over. Purchased credit packs do not expire while your account remains in good standing. Consumption rates by action type are published in-product and may be adjusted with prior notice.

3.3 Billing

Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You authorize us and our payment processor (Stripe) to charge your chosen payment method. Taxes may apply.

3.4 Refunds

You may request a refund of a subscription payment within 14 days of the charge if you have made minimal use of paid features during that period. Credit pack purchases and consumed credits are non-refundable. Statutory rights that cannot be waived under applicable law are unaffected.

3.5 Cancellation

You may cancel a subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period; you retain access until then.

4. Acceptable Use

You agree not to use the Service to:

  • violate any law, regulation, or third-party right;
  • generate, host, or distribute malware, phishing content, or unlawful content;
  • produce content that sexually exploits minors, incites violence, or facilitates targeted harassment;
  • attempt to reverse engineer, probe, or disrupt the Service, its underlying models, or sandboxes, except as permitted by law;
  • resell, sublicense, or provide the Service to third parties as a competing offering without our written consent;
  • exceed documented rate limits, evade credit metering, or abuse referral or trial mechanics.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

5. Your Content & Projects

You retain all ownership rights in the code, prompts, files, and other materials you upload or create using the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, execute, and process Your Content solely to operate, secure, and improve the Service for you.

You are responsible for Your Content, including ensuring you have the rights necessary to upload and use it, and for keeping your own backups of anything important.

6. AI Output

Subject to your compliance with these Terms, we assign to you all rights we may have in the output generated for you by the Service ("Output"). Output is provided as-is; it may be inaccurate, incomplete, or infringe third-party rights. You are responsible for reviewing Output before relying on it, deploying it, or shipping it to end users. Similar Output may be generated for other users.

7. Third-Party Services

The Service integrates with third-party providers including AI model providers (e.g. OpenAI, Google, Replicate), sandbox providers (e.g. E2B), payment processors (Stripe), authentication providers, and email providers. Your use of those services is subject to their terms, and we are not responsible for their acts or omissions.

8. Intellectual Property

The Service, including its software, design, trademarks, and documentation, is owned by us and our licensors and is protected by intellectual property laws. Except for the rights expressly granted in these Terms, no license is granted to you.

9. Confidentiality & Security

We implement industry-standard technical and organizational measures to protect the Service. No system is perfectly secure; you use the Service at your own risk. Do not upload secrets you cannot afford to have exposed; use the dedicated environment variables feature for credentials.

10. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE"WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR LEGALITY OF ANY AI OUTPUT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

12. Indemnification

You will defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your Output as used or distributed by you, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued operation would create a security or legal risk. Sections that by their nature should survive termination will survive.

14. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which InMedia Developer AI is established, without regard to conflict-of-laws principles. The courts of that jurisdiction will have exclusive jurisdiction over disputes, subject to any mandatory consumer protections available to you locally.
